How Family Law Mediation Works in Massachusetts

One practical advantage of mediation is scheduling flexibility. Instead of waiting for a court date, parties can arrange sessions at times that work for both sides. The process generally moves faster than litigation, which involves discovery, evidentiary procedures, and the possibility of appeals. Mediation in Massachusetts may cost 40% to 60% less than taking a matter to trial.

Mediation is also voluntary. If both parties can’t reach an agreement, they retain the right to proceed before a judge. No one is locked into the outcome of a session that doesn’t work.

Confidentiality Under Massachusetts Law

Massachusetts General Laws Chapter 233, Section 23C protects what happens in mediation. A mediator’s work product and communications made during sessions aren’t subject to disclosure in judicial or administrative proceedings, giving both sides the freedom to negotiate candidly.

Once the parties reach an agreement and a judge signs it, that agreement carries the same legal effect as a court judgment. One distinction worth noting: agreements for judgment reached through mediation generally can’t be appealed the way a judge-ordered judgment can, which is reason to approach the drafting carefully.

When Mediation Isn’t the Right Fit

Mediation works best when both parties are willing to communicate and compromise. When that condition isn’t met, the process loses its foundation. Situations involving domestic violence or a significant imbalance of power between the parties may not be appropriate for mediation at all.
