Massachusetts Visitation Law: What Newton Parents Should Know

Massachusetts courts apply the “best interests of the child” standard when setting a parenting time schedule. Unlike some states, Massachusetts doesn’t provide a statutory checklist. Under G.L. c. 208, §31, judges exercise broad discretion, weighing factors such as each parent’s relationship with the child, the child’s school and community stability, each parent’s willingness to support the other’s relationship with the child, and any history of neglect or domestic violence.

A typical noncustodial parenting schedule might include one or two evenings per week, every other weekend, and specific provisions for holidays, school vacations, and special occasions. No two families are identical, and the Middlesex Probate and Family Court tailors every parenting plan to the family’s actual circumstances. Parents who agree on a schedule can submit it to the court for approval; when they can’t agree, the court decides. Massachusetts courts generally favor arrangements that preserve a meaningful relationship between the child and both parents.

When Courts Order Supervised Visitation

A court may order supervised visitation when a parent has a history of domestic violence, a serious substance abuse problem, or another condition that could place the child at risk during unsupervised contact. Under a supervised order, the noncustodial parent may only spend time with the child in the presence of a designated third party, either a trusted family member or a professional at a supervised visitation center. Such centers exist throughout Massachusetts for cases where the court requires a neutral professional setting. In rare circumstances where any contact would seriously harm the child’s wellbeing, a court may deny parenting time entirely.

Modifying a Parenting Time Order

Either parent may petition the Middlesex Probate and Family Court to modify an existing visitation order. To seek a modification, the petitioning parent must demonstrate a “material and substantial change in circumstances” since the original order was entered. Courts have found that standard met by a parent’s relocation, a significant change in work schedule, a serious health development, or a pattern of failing to follow the existing plan.

Even when both parents agree to a new schedule, submitting the modification to the court for formal approval is advisable. An informal agreement isn’t enforceable the way a court order is. If the custodial parent plans to relocate out of state with the child, the noncustodial parent must be notified and given an opportunity to respond. If the parents can’t agree on how relocation affects parenting time, the court will decide.

Enforcement & Custodial Interference

When a parent repeatedly violates a court-ordered parenting schedule, the other parent may file a Complaint for Contempt with the Middlesex Probate and Family Court. Custodial interference takes many forms: withholding the child entirely, chronic late exchanges, appearing during the other parent’s scheduled time, or systematically alienating the child from the other parent. A judge who finds contempt may order make-up parenting time, impose fines, or in serious cases, order the violating parent to serve time in jail.

One point that often surprises parents: child support and visitation are legally separate obligations. A parent can’t legally withhold parenting time because the other parent is behind on support payments, and a parent can’t withhold support because parenting time is being denied. Each must be enforced through its own court process.

Visitation Rights for Unmarried Parents

Under Massachusetts law, an unmarried mother is presumed to have sole legal and physical custody of a child in the absence of a court order. An unmarried father has no automatic parenting rights until legal paternity is established. Paternity can be acknowledged voluntarily or established through a court-ordered paternity action in the Middlesex Probate and Family Court, which may involve DNA testing if parentage is disputed.
